Legal
Terms.

About these terms
These terms cover your use of naylorandco.com and the travel design work Naylor & Co. carries out for you. They sit alongside, and do not replace, the booking terms of Colletts Travel Limited, which govern the travel arrangements themselves.
Naylor & Co. is the trading name of Jessica Naylor, an independent travel consultant. The business address is 79 Brent Street, London NW4 2EA, telephone +44 7795 062974. All bookings are made through Colletts Travel Limited and are arranged under their licence, with Colletts Travel Limited acting as the licence holder.
The work
The practice designs and arranges private travel for a small number of households. The work includes an introductory conversation, a structured brief, itinerary design, supplier selection, booking, pre-departure documentation, and support during the journey.
Our role
Naylor & Co. is the trading name of Jessica Naylor, an independent travel adviser. Naylor & Co. designs and recommends your journey. All travel is booked with Colletts Travel Limited, the licence holder, which accepts your booking, contracts with you for your travel arrangements, takes your payment and issues your booking confirmation. Colletts Travel Limited is responsible to you for the travel services it books under its booking terms and, where your booking is a package, under the Package Travel and Linked Travel Arrangements Regulations 2018. Naylor & Co. takes no payment from you directly.
Financial protection for your booking
Financial protection for your travel arrangements is a matter for the licence holder, not for this practice. What applies to your booking, and what it covers, is set out in the booking terms and conditions of Colletts Travel Limited. Please read them. You will also be told, in writing and before you confirm, which protection applies to your particular arrangements.
Quotes and booking
- A quote is indicative until booked. Rates, availability, taxes and currency components can move before a booking is confirmed.
- Quotes are valid for seven days unless stated otherwise in writing.
- A deposit is normally required to proceed. The amount and the balance date are set by the suppliers and the licence holder, and confirmed to you in writing.
- Once confirmed, each supplier's cancellation, amendment and refund terms apply, and will be summarised for you at the point of confirmation.
Prices
The total price quoted includes all mandatory charges known at the time of quoting. Where a cost genuinely varies with use, such as hotel incidentals, in-room dining, optional excursions or foreign exchange on local card spend, it is flagged separately and not included in the headline figure.
Prices are quoted in pounds sterling or US dollars as suits the booking. Exchange rate movement between quote and balance can affect journeys not denominated in sterling. Where a rate is fixed, that is stated in writing.
No separate design fee
The practice charges nothing for designing your journey or booking your hotels. What you pay is the price of the travel, set out in your proposal and paid to Colletts Travel Limited, the licence holder. I am paid out of the travel price. I receive a share of the commission that hotels and other suppliers pay on your booking and, on some bookings, a margin I add to the supplier's nett price. Both are included in the price I quote you, so where I add a margin you pay more than the nett price for that item. You see the full price of everything booked through Colletts Travel Limited before you confirm, with any charges payable locally set out where they are known, and you pay it to Colletts Travel Limited, the licence holder. I never add a fee or margin after you confirm. Any later change to the price can only be made by Colletts Travel Limited, and only where its booking terms allow it.
Insurance, passports and entry requirements
Travel insurance is a requirement for every journey arranged by the practice, and it must be in place from the moment the first deposit is paid, not from the balance date. The gap between the two is exactly the period in which a cancellation costs you money and an insurer would have covered it. Cover should include medical evacuation, repatriation, cancellation and interruption, baggage, and any pre-existing conditions. Travelling without it is at your own risk. The practice is not authorised to give regulated insurance advice and recommends you take independent advice.
Ensuring that passports, visas, electronic travel authorisations and health requirements are valid for every destination and connecting country is your responsibility. Known requirements will be flagged and you will be pointed to the authoritative sources, but third-party information cannot be guaranteed accurate at the date of travel.
Our responsibility to you
We will provide our design service with reasonable care and skill. If we fail to do so, we are responsible for loss or damage you suffer that is a foreseeable result of our failure. Loss is foreseeable if it was obvious it would happen, or if both of us knew it might happen when you agreed to our service. We are not responsible for loss that is not foreseeable, or for business losses.
We do not exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
Your travel is booked under a separate contract with Colletts Travel Limited, the licence holder. Colletts Travel Limited is responsible to you under its booking terms and, where your booking is a package, under the Package Travel and Linked Travel Arrangements Regulations 2018. We are not responsible for the performance of travel services by Colletts Travel Limited or its suppliers, but this does not affect our responsibility for our own advice.
Events outside our control
Neither party is liable for failure or delay caused by events beyond reasonable control, including war, civil unrest, terrorism, pandemic, government action, airspace closure and natural disaster. In those cases the practice will work in good faith to find alternatives or to refund what can be refunded. This does not affect any financial protection that applies to your booking.
Complaints
If something goes wrong during a journey, tell the practice and the supplier or local representative straight away, so it can be dealt with while you are still there. For a formal complaint afterwards, please write to jessica@naylorandco.com within twenty-eight days of returning, so it can be looked into while the details are fresh. It will be acknowledged within five working days. This does not affect your legal rights.
Complaints about the travel arrangements themselves, and the routes of redress open to you, are dealt with under the booking terms of the licence holder.
Governing law
These terms are governed by the laws of England and Wales, whose courts have non-exclusive jurisdiction.
Changes
These terms may be updated. The version in force on the date of your booking governs that booking.
